1.2 Pirelli Tyres Australia Pty Ltd, with registered offices at Building B, City West Business Park, 33-35 Saunders Street, Pyrmont NSW 2009, Australia (hereinafter referred to as “Pirelli”, “we”, “us” or “our”, as appropriate) will act as the “APP entity” responsible for your personal information for the uses detailed in Section 4.
1.3 This Privacy Policy is available free of charge and may be made available in other formats on request to meet the needs of individuals with disabilities. We provide this Privacy Policy at or before the time we collect your personal information, or as soon as practicable afterwards.
2. COLLECTION OF INFORMATION
2.1 We collect personal information in accordance with the Australian Privacy Principles (also referred to as "APP") set out in the Privacy Act 1988 (Cth) which include information that can be used to identify you, including - but not limited to - your first and last name, date of birth, street address, ZIP/postal code, city, country, state, phone number, email and any other form of identification (hereinafter as "Personal Information").
2.2 When you visit our website(s), we may collect information about your device, browser, and browsing behaviour. This information is collected by installing small text files called “Cookies” and other similar information technology techniques (collectively referred to as “Cookies”). In addition to other functions, when you visit our website(s) again, the Cookies previously stored allow us to recognize your browser. Cookies may store unique identifiers, user preferences, or other information as described in our Cookie Policy. Different types of Cookies may be used, including strictly necessary, analytics, and marketing Cookies, each subject to different consent requirements. 3. USE OF PERSONAL INFORMATION
3.1 We may collect and use your Personal Information for the following purposes set out below to the extent permitted by law:
(i) to allow your registration to our website(s);
(ii) to respond to your requests of assistance;
(iii) to provide you with the information which you have requested, by way of example about new products and/or services offered by Pirelli;
(iv) to allow you to take part in certain activities, events, initiatives or contests.
3.2 The processing of your Personal Information for purposes of this Section 3.1 is considered a primary purpose of collection under the Australian Privacy Principles (APPs) and in accordance with APP6.1(a), does not require your express consent. The provision of your Personal Information is voluntary but necessary to enable us to fulfil these purposes. Where necessary for these purposes, we may disclose your Personal Information to our group entities located in the European Union. In accordance with APP 8, we will take reasonable steps to ensure those entities handle your Personal Information in a way that is substantially similar to the protections afforded by the APPs, including by entering into contractual arrangements. In the event you do not provide us your Personal Information, it will be impossible for us to carry out such activities.
3.3 Pirelli may also use your Personal Information for direct marketing purposes, but only with your prior and informed consent in accordance with APP 7. If you consent, we may transfer your Personal Information to entities in the European Union for marketing purposes, provided such transfers comply with APP 8. We will seek your explicit consent for marketing communications at the point of data collection, typically via an opt-in check box or registration form.
3.4 With your consent, Pirelli will be entitled to use your Personal Information to send you any promotional emails (including newsletters) and other commercial electronic communications. We may use your personal information to send you marketing communications by email, messaging, phone, push notifications and direct messages, but only if you provide your consent. You can always manage or withdraw your consent to marketing communications. To opt-out from receiving future marketing emails, simply click the link labelled “unsubscribe” at the bottom of any email Pirelli sends you. You can also manage or update your communication preferences at any time through the “My Metzeler” personal area or the preference centre.
4. SHARING OF PERSONAL INFORMATION
4.1 We may share your Personal Information where authorised or required by law, or as follows:
(a) Pirelli Group companies. Your Personal Information may be shared with Pirelli & C. S.p.A. and/or its subsidiaries located in Europe where necessary to fulfil the purposes for which it was collected. Such sharing is subject to appropriate privacy safeguards.
(b) Third Parties (Service Providers, Suppliers). Your Personal Information may also be processed by service providers who provide services on our behalf, including event partners, marketing service providers and insurers. These third parties only act on our instructions and are subject to confidentiality agreements with us and other legal restrictions that prohibit them from using the information for any purpose other than performing the specific services on our behalf, unless you have explicitly agreed or given your prior permission to them for additional uses. Where these third parties are located overseas, we take reasonable steps to ensure that they comply with privacy obligations equivalent to the Australian Privacy Principles (APPs), through data processing agreements and due diligence.
Where we disclose your personal information to overseas recipients, these recipients are most commonly located in the European Union, but may also be located in other countries where Pirelli Group entities or service providers operate. Before disclosing your personal information overseas, we will take reasonable steps to ensure that the overseas recipient does not breach the Australian Privacy Principles in relation to your personal information. This may include entering into contractual arrangements with the recipient to ensure substantially similar privacy protections. If it is not practicable to ensure that the overseas recipient complies with those protections, we will inform you of this and obtain your consent before making the disclosure, unless otherwise permitted by law.
(c) Legal obligations and protection. In certain cases, we may be required to provide Personal Information in response to a valid court order, subpoena, government investigation, or as otherwise required by law. We also reserve the right to report to law enforcement agencies any activities that we, in good faith, believe to be unlawful or in violation of applicable laws. We may release certain Personal Information when we believe that such release is reasonably necessary to protect the rights, property, and safety of others and ourselves, or to detect, prevent, or otherwise address fraud, security, or technical issues.
(d) Business transfers. In the event that we intend to sell or transfer ownership or control of any or all of our business, operations or services to a third party, we may need to disclose your Personal Information to a potential buyer both before and after the purchase. Any such disclosure will be conducted in accordance with the Privacy Act 1988 (Cth), and we will require the recipient to handle your Personal Information in a way that is consistent with this Privacy Policy. In the event the sale goes through, we will require that the receiving party agree that they will be similarly bound by the provisions of this Privacy Policy and that they will only use and disclose your Personal Information as we are similarly entitled under this Privacy Policy. In the event the sale does not go through, we will require the potential purchaser to not use or disclose your Personal Information in any manner whatsoever and to completely erase the same.
4.2 We will not sell, trade, or otherwise disclose your personal information to third parties other than as set out above, or if required by law.
5. YOUR PRIVACY RIGHTS
5.1 You have several privacy rights in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). These include the right to:
a) access the personal information we hold about you;
b) request correction of any of your personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading; and
c) make a complaint if you believe we have breached your privacy.

We may not be able to accommodate every request related to certain information if we believe this would violate any law or other legal requirement, or other data subjects' rights. 6. HOW TO MAKE A COMPLAINT ABOUT A BREACH OF YOUR PRIVACY RIGHTS
6.1 If you believe that we have breached the Australian Privacy Principles (APPs), the Privacy Act 1988 (Cth), or any applicable privacy code in our handling of your personal information, you may make a complaint by writing to us using the contact details set out below. We will acknowledge receipt of your complaint and endeavour to investigate and respond to you in writing within a reasonable period (generally within 30 days). 7. RETENTION OF PERSONAL INFORMATION
7.1 We will retain your Personal Data as follows:
(i) if you have submitted support requests without creating an account, for a period of 1 (one) year from our last communication;
(ii) if you have created an account, for a period of 7 (seven) years from the date of collection, except where it is necessary to retain it for longer periods due to mandatory provisions of law;
(iii) for marketing purposes, for a period of 7 (seven) years from the date we obtain your marketing consent, unless you withdraw your consent earlier (in which case we will cease using your Personal Data for marketing). In all cases, this only applies to individuals who have provided marketing consent.
7.2 This 7-year period reflects the need to establish consistent data management practices at a group level, in accordance with applicable regulations, the expected lifecycle of our products and our customers’ reasonable expectations to receive relevant updates and offers. We regularly review our retention practices to ensure they remain appropriate and in line with legal requirements. You may withdraw your consent or request deletion of your data at any time.
7.3 Furthermore, if within the period indicated in paragraphs (ii) and (iii) you take actions on your account or on one of Pirelli's websites or apps (such as, by way of example and not limitation, registering for promotions or events, requesting new services, responding to surveys) that demonstrate your interest in maintaining the account or your relationship with Pirelli related to Pirelli's products and/or services and/or Pirelli group companies, we will retain your Personal Data for an additional 7 (seven) years from the date of such action, without, however, sending marketing communications in the absence of your specific consent.
7.4 You may withdraw your consent to receive marketing communications at any time. If you do so, we will cease using your Personal Data for direct marketing as soon as practicable.
7.5 Following the data retention periods for the purposes stated above, your Personal Data will be archived and retained where necessary (for example, in relation to products and/or services you have purchased or used, or in the event of your participation in contests), for the period of time required by applicable laws concerning the storage of data and documents for administrative, accounting, tax, and defensive purposes (in accordance with the applicable statute of limitations).
7.6 Once your Personal Data is no longer required for any lawful purpose, it will be securely destroyed or de-identified in accordance with our data governance policies and applicable privacy laws.
8. PRIVACY POLICIES OF THIRD PARTIES
8.1 This Privacy Policy only addresses the use and disclosure of information by Pirelli. We are not responsible for the privacy policies of third parties and encourage you to review them separately.
9. SECURITY OF PERSONAL INFORMATION
9.1 We have security protocols and robust technical and organisational measures in place to protect your Personal Information from unauthorised access, improper use or disclosure, unauthorised access, misuse, interference, improper use or disclosure, modification, and unlawful destruction and accidental loss. We only allow access to our systems and data storage environments when necessary, and then under strict guidelines to ensure such access is limited to authorised personnel for legitimate business purposes.
9.2 It is your responsibility to protect the security of your login information, and we recommend that you use a unique password for our website(s) that is different from the password you may use on any other site. You should also take reasonable steps to safeguard your devices and regularly update your passwords. We are not responsible for any unauthorised access that results from failure to maintain the confidentiality of your login credentials.
